CC&Rs, What are they?

Declarations of Covenants, Conditions and Restrictions (CC&Rs) is one governing document that sets out the rules of a homeowner’s or commercial condominium association. It is designed mainly to protect property values within the community. There are various types of association communities commercial, condominium, master-planned, mid/high rise, and single family. Being a property owner in an association means obeying the requirements and limitations of the CC&Rs. For the state of California, the courts have held that they are enforceable unless they violate specific policies. 

Please keep in mind that some may have more requirements and property limitations than others. We want to provide you with a list of things that you may find in common with CC&R restrictions and requirements:

  • Property maintenance: landscape and lawn, exterior paint, broken shudders, and light fixtures. 
  • Home Decorations: how a homeowner can permanently or temporarily decorate their property. Examples: Christmas decorations or potted plants. 
  • Parking: passes, overnight guests, and required parking areas. 
  • Aesthetics: some interior and exterior changes can require approval.

The best way to fully grasp and understand what your association CC&Rs contain may require some due diligence. Please obtain a copy and read through them. Contact your property management company if you cannot get a copy or are unsure of the document’s contents. One of the many employees’ jobs is understanding each HOA community’s CC&Rs.
